There are now more visitors to India from different countries due to global changes & reasons such as work/studies/research/as well as long visits. The increased focus on compliance with immigration laws and admission of Foreign Nationals (and their consequent registration with the FRRO or FRO upon arrival) has caused an increase in regulation of entry into India by Foreign Nationals.
India has made recent Legislative amendments that have resulted in a Unified Legislative Framework for Foreign Nationals entering, remaining in, registering with, and exiting India through the passage of the Immigration & Foreigners Act 2025 and the Immigration & Foreigners Block Rules 2025 – combining several existing Acts regarding the movement of foreign nationals into India into one “regulatory framework” for Foreigners.
The Foreigners Regional Registration Office (FRRO), part of the Bureau of Immigration, Ministry of Home Affairs, oversees and regulates the presence of foreign nationals within India.
The FRRO maintains a record of all non-Indian nationals who have been residing in India for extended periods of time through their registration. Once you are registered with the FRRO, you will receive both a Registration Certificate (RC) and a Residential Permit (RP). This will establish your ability to reside in India in accordance with Indian law. Most foreign national registration processes will occur electronically through the e-FRRO in an effort to reduce your need to visit the FRRO to ensure compliance with the law.
The visa category, duration of stay, and nationality determine whether or not a foreign national must register with the FRRO/FRO. The registration with FRRO/FRO at a place of residency is mandatory for foreign nationals in case they are planning to reside in India for more than 180 days.
Certain visa types require registration irrespective of the length of stay if the visa is valid for more than 180 days. The most common examples of these are: Employment Visas, Student Visas, Medical Visas, Research Visas, Missionary Visas, and Project Visas. Whereas, Business Visa holders do not need to register with the FRRO/FRO unless the cumulative total of time spent in India exceeds 180 days.
The Immigration and Foreigners Rules required all traditional long-term visa holders (Employment, Student, Medical, Research, Missionary, and Project Visa Holders) who were required to register within 14 days upon arrival in India, to register where applicable.
In 2026, the Immigration and Foreigners Rules Amended Regulations made tremendous compliance changes. Most of the foreign nationals who met the 180-day threshold to register used to have a grace period within which they could have registered. As per the amended rules, it is now mandated that foreigners register before they reach the 180-day (day using more than 180 days of presence in India). Therefore, there is no longer a virtual grace period for registering after the 180-day (180 days of absence on 180 days of presence in India).
The amendment illustrates the government’s desire to enhance the monitoring of long-term foreign residence; moving forward, only in exceptional circumstances will there be any permitting of delayed registrations.
- There are exceptions to the requirement for all foreign citizens to register:
- Foreign nationals holding a visa valid for 180 days or less, provided they leave India within that period, unless their visa specifically requires registration upon arrival.
- Foreign nationals holding a visa valid for more than 180 days but containing the condition “each stay shall not exceed 180 days”, provided they do not stay in India for more than 180 days on any single visit or cumulatively during a calendar year.
- Children below 12 years of age.
- Overseas Citizen of India (OCI) Cardholders.
The e-FRRO System has made the process of immigrating to India easier than ever by allowing nearly all aspects of registering your immigration process to occur online and electronically rather than through paper-based methods. The standard procedure for using these services on the e-FRRO System entails creating a user account on the website, completing an online application for your registration and submitting it, uploading the documents required by the immigration office to verify your identity and completing any other forms, and then having your application processed and receiving a verification number or a Registration Certificate (RC) and a Residential Permit (RP) if your application is approved. Depending upon the particular circumstances surrounding your application, the immigration office may request additional documents from you, conduct an interview with you or make an in-person attempt to verify information submitted in your application.
Although each visa type requires its unique types of documents to register your Visa Application, many of the same types of documents will be required for their respective Visa Applications. Examples can include but are not limited to: a properly Valid Passport and/or Visa, two (2) Recent Identifiable Photograph(s), Current Proof of Residence within India, and any additional documentation that is required due to the specific type of Visa that you possess, e.g., an employment contract, Admission Letter, or sponsor letter. Your application may be delayed or subject to a level of scrutiny that may not usually be required, depending upon the availability and accuracy of the information submitted with your Visa Application.
A foreign national’s failure to register may cause serious consequences for him/her, such as fines, difficulty extending his/her status, delays in departing India, denial of future visa applications, investigations by immigration authorities, and/or prosecution for violating any applicable law governing immigration. Therefore, all foreign nationals, their employers, educational institutions, and sponsorship organizations need to ensure timely registration and continued compliance with all applicable immigration laws while they are present in India.
In 2025, the Indian Government made various amendments to the Immigration and Foreigners (Amendment) Act, 2025; additionally, certain regulations were amended to reflect the digitization of the processes for immigration applications. The amendments also changed Indian law to permit the Government of India more direct supervision over foreign nationals’ activities after entering India and emphasized the enforcement of immigration law through increased restrictions on the immigration process.
The growing demand for timely immigration compliance and the FRRO registration process to be a legally enforceable requirement (versus merely a “need to comply” process), was demonstrated by the removal of the 180-day grace period for foreign nationals to register within 180 days after entering India. As a result, foreign nationals and/or their sponsors must ensure they register with the FRRO promptly and have retained appropriate evidence of their residential address in India; additionally, they need to continue to be vigilant in keeping current on immigration regulations so that they remain in an immigration status in India without any issues or concerns.
